Terms and Conditions AirascOur agreement with you is made up of the terms and conditions below. In these conditions “we”, “our” and “us” means Airsac® and Network Packaging, a division of Macfarlane Group UK. “You” and “your” means you, the customer and your business.

Words with special meanings or references:

  • “Goods” refers to the packaging materials and/or machinery being supplied to the customer by Network Packaging, a division of Macfarlane Group UK Limited.
  • “Contract” refers to agreement made between Network Packaging and the customer when the customer places an order and Network Packaging, a division of Macfarlane Group UK Limited agree to supply the goods. 
  • “In writing” must be by post, email or fax, unless otherwise stated in the below Terms and Conditions of Trading. 
  • “Working day” refers to any day which is not a Saturday, Sunday or an English public or Bank Holiday.


1. Prices and Ordering

1.1. All prices quoted on the website exclude VAT (unless otherwise stated). VAT will be charged at the current rate of VAT that applies at the time you place your order.

1.2. All prices quoted exclude delivery. Delivery charges can vary depending on order value, size and your location. For details of our delivery charges, please refer to the delivery page .

1.3 When confirmation of an order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between you and Network Packaging, a division of Macfarlane Group UK Limited. Network Packaging, a division of Macfarlane Group UK Limited will indicate acceptance of your order, and hence a contract between you and Network Packaging, a division of Macfarlane Group UK Limited.

1.4. At any time before delivery we may adjust the price of the goods to reflect any increase in our costs of supplying the goods. In case of a price change, we will always contact you first to ensure that the price is acceptable.

1.5. Where palletised deliveries are requested or necessary, pallets may be charged in addition to the cost of goods and delivery. The cost of pallets subsequently returned to us (at your expense), in good condition, will be credited to your account at the price originally charged.


2. Deliveries, Collections and Title

2.1. Deliveries are restricted to the UK only and will only be made on working days.

2.2 All delivery times quoted are estimates only.

2.3. If we fail to deliver within a reasonable time, you may (by informing us in writing) cancel the contract, however:

2.3.1 you may not cancel the contract if we receive your notice after the goods have been dispatched;

2.3.2 if you cancel the contract, you have no further claim against us under the contract.

2.4. If you accept delivery of the goods after the estimated delivery time, it will be on the basis that you have no claim against us for delay (including indirect or consequential loss, or increase in the price of the goods).

2.5. We may deliver the goods in instalments. Each instalment is treated as a separate contract. Where goods will be delivered in instalments, this will be agreed with you.

2.6. We may decline to deliver if:

2.6.1. we believe that it would be unsafe, unlawful or unreasonably difficult to do so; and/or

2.6.2. your premises (or the access to them) are unsuitable for our vehicle.

2.7. You can choose to collect your order directly from Network Packaging Ltd. If you choose to do so, you are required to provide two forms of identification (I.D):

  • One photographic I.D. (e.g. driving license or passport etc.) 
  • One form of I.D. that shows your full name and invoice address (e.g. a utility bill or similar)

2.8 Title to the goods will only pass to you on receipt of payment in full of the price of the goods, including all relevant taxes and delivery costs. We reserve the right to repossess goods in your possession if payment is not made in full.


3. Payment Terms

3.1. Network Packaging only accepts payments Visa, Mastercard, Switch, Visa Electron and Debit Cards, PayPal and credit account payments (subject to status) as valid methods of payment.

3.2. For orders placed using credit and debit cards or PayPal, you are to pay us on point of order.

3.3 If you have an approved credit account payment is due no later than the end of the month after the month of our invoice unless otherwise agreed in writing.

3.4 If you fail to pay us in full on the due date:

3.4.1 we may suspend or cancel future deliveries.

3.4.2 we may cancel any discount offered to you;

3.4.3 you must pay us interest at the rate equivalent to that set for the purposes of s6 of the Late Payment of Commercial Debts (interest) Act 1998: a. calculated (on a daily basis) from the date of our invoice until payment; b. compounded on the first day of each calendar month; and c. before and after any judgment (unless the court orders otherwise).

3.5. If you have an approved credit account, we may withdraw it or reduce your credit limit or bring forward your due date for payment. We may do any of this at any time without notice.


4. Credit Card Security

4.0 When an order is placed on the Airsac website, credit and debit card numbers are encrypted using 128 bit encryption. They are only decrypted after then reach Network Packaging’s computer. They are not held in clear text on any website. Please see Security & Privacy for more information.


5. Guarantee and Returns Policy

5.1. Your rights to return goods are protected under the EU Distance Selling Directive.

5.2. We guarantee your satisfaction. We will offer a full refund (excluding delivery charges) for any items returned to us in their original unspoilt resalable condition within 30 days.

5.3. Returns must be agreed in writing with us and can be arranged via post or collection. We cannot accept liability for any goods that are lost when returned via post.

5.4. You will bear the cost of returning the goods to us, unless the goods are being returned because they are incorrect or defective, in which case we will arrange for the goods to be collected.

5.5. On receipt of returned goods, we will issue a credit, exchange or refund to the total value of the goods returned to us, subject to the goods being returned in an unspoilt, resalable condition.


6. Liability

6.1. If you detect any defect in the quality, quantity and/or condition of the goods, you should notify us in writing, on receipt of the goods and you should refuse the delivery. If you do not notify us of and refuse the delivery, we will not accept liability for such defect and you will be required to pay for the goods in full.

6.2. We will inspect the goods returned and if the defect is identified, you will be given the option of replacement at no additional cost or a full refund of the price of the goods. We will have no further liability to you.

6.3. We will inspect the goods returned and if no defect is identified, the goods will be returned to the Customer at the Customer's cost.

6.4. Under no circumstances will we be liable to you for any loss of profits, additional costs, indirect or consequential loss or damage arising out of any defect in goods supplied. Our liability will be restricted to the value of goods returned found to be defective on inspection. This does not affect your statutory rights as a consumer or our liability to you for fraudulent misrepresentation or for death or injury resulting from our negligence.

6.5. Any disputes or issues with deliveries must be raised within 30 days of receiving your invoice. No liability will be accepted after this time.


7. Privacy Policy

7.1. We do not disclose your information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

7.2. Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store deliver addresses if you use the address book feature and to sore your details if you select the “Remember Me” option. Cookies are also used after you have logged on as part of that process. You can turn off cookies within your bowser by going to “Tools |Internet Options | Privacy” and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies. Please see Security and Privacy for more information.


8. Cancellation

8.1. We may suspend or cancel the order, by written notice if:

8.1.1. you fail to pay us any money when due;

8.1.2. you become insolvent;

8.1.3. you fail to honour your obligations under these terms.

8.2. You may not cancel the order unless we agree in writing


9. Waiver and variations

9.1. Any waiver or variation of these terms is binding in honour only unless:

9.1.1 made (or recorded) in writing;

9.1.2 signed on behalf of each party; and

9.1.3 expressly stating an intention to vary these terms.

9.2. All orders that you place with us are placed under these terms (or any terms that we may issue to replace them). By placing an order with us, you are expressly waiving any printed terms you may have to the extent that they are inconsistent with our terms.


10. Force majeure

10.1. If we are unable to perform our obligations to you (or able to perform them only at unreasonable cost) because of circumstances beyond our control, we may cancel or suspend any of our obligations to you, without liability.

10.2. Examples of those circumstances include acts of God (i.e. natural disasters beyond human control), accident, explosion, fire, transport delays, strikes and other industrial disputes and difficulty in obtaining supplies.


11. General

11.1. The validity, legality or enforceability of any part of these terms and conditions will be unaffected by the invalidity, illegality or unenforceability of any individual part of these term and conditions.

11.2 English law is applicable to any contract made under these terms. The English and Welsh courts have nonexclusive jurisdiction.

11.3. All pictures displayed are a representation of the item and may vary for the image displayed.

12. Offers and Promotions Online

12.1. Only one offer, voucher, discount or promotion is valid per order.

12.2. Any offer, voucher, discount or promotion can be withdrawn at any time without notice.

12.3. Offers and promotions only apply to RRP prices.

12.4. When delivery charges are incurred, these will be taken into account when price matching.
